Last Updated: June 27, 2024

The DMCA Policy provided herein is exclusively intended for the purpose of reporting content that infringes upon copyrights, as identified within the confines of the VR PornWatch platform.

DMCA Notice & Removal Procedures

While our digital platform (referred to herein as "Website") is not situated within the jurisdiction of the United States, we maintain a strong commitment to upholding the intellectual property rights of copyright holders. Consequently, we have opted to adhere to the Notice and Takedown requirements stipulated within the Digital Millennium Copyright Act ("DMCA"). Our Website is categorized as a "Service Provider" in accordance with the provisions outlined in 17 U.S.C. § 512(k)(1) of the DMCA, thereby qualifying for the protections against claims of copyright infringement commonly known as the "safe harbor" provisions.

We, as an entity, hold intellectual property in high regard and extend this respect to others. In this spirit, we request that all users of our platform do the same. To ensure compliance with the DMCA and address concerns regarding potential copyright infringements, we have established the following comprehensive Notice & Removal Procedures.

Notice of Infringement

Should you believe that your intellectual property has been replicated and published on the Website in a manner that infringes on your copyrights, we kindly request that you provide our Designated Copyright Agent with the details outlined below:

(b) A comprehensive description of the copyrighted material that is the subject of your infringement claim.
(c) A precise location of the purportedly infringing content on the Website, including the specific URLs that are associated with the disputed material.
(d) Your contact information, including your residential or business address, telephone number, and electronic mail address.
(e) An affirmation from you, attesting to your good faith belief that the utilization of the content in question is not sanctioned by the copyright proprietor, its representative, or the prevailing legal statutes.
(f) A declaration by you, under the penalty of perjury, affirming the veracity of the information provided within your notification and confirming your status as the copyright owner or as an individual authorized to act in the stead of the copyright owner.

Please direct your Notice of Infringement to our email address: admin@vrpornwatch.com.

How We Process Notices

Upon the receipt of any notification purporting copyright infringement, the stipulated Removal Procedures shall be duly applied. The Website maintains the prerogative to terminate access to, or eradicate, any content or activity present within the Website's domain that is reportedly infringing or manifests apparent infringing behavior, contingent upon the prevailing circumstances. The Website is steadfastly committed to adhering to the stipulations delineated in 17 U.S.C. §512 of the Digital Millennium Copyright Act (DMCA), which provides the procedural framework for addressing copyright infringement claims.

The DMCA Removal Procedures, as previously elucidated, are predicated upon the receipt of a Notice that conforms to the requirements set forth in §512 of the DMCA. In the event that the Notice aligns with the three notification elements outlined in §512, yet falls short of complete compliance, the Website shall endeavor to establish contact with the aggrieved party to facilitate adherence to the mandated format. The Website's Designated Agent is responsible for receiving such notifications.

Upon verification of a valid Notice, the Website shall promptly remove or disable access to the content in question. Concurrently, the affected user shall be notified of the action taken. The affected party may then submit a counter-notification to the Designated Agent, incorporating a declaration under penalty of perjury affirming a bona fide belief that the content was removed due to a misidentification.

Once the Designated Agent has received the counter-notification, the content in question shall be reinstated unless the Designated Agent is apprised of the initiation of legal proceedings by the complaining party, specifically a court-filed request for an injunction against the purported infringing activity. This process ensures a balanced approach to safeguarding intellectual property rights while upholding the principles of fairness and due process.
